Marital and Non-Marital Assets/Liabilities

During a dissolution  of marriage, the parties are required to list their assets and liabilities.  The Court will then look at whether the property is “marital” or “non-marital.”  Marital property is subject to be divided by the Court or by the parties in the marital settlement agreement.  Non-marital property is not divided at all.

Loss Mitigation

Current Florida law holds that when a person defaults on an installment payment contract, the lender has the right to accelerate the loan and declare the total amount due, meaning if the default is on a mortgage loan, the homeowner must pay off the entire debt or be foreclosed.
